The Healthy Eating Clinic website at http://www.healthyeatingclinic.com.au are owned and operated by The Healthy Eating Hub Pty Ltd ABN 48 606 533 662 (THEH, we, us, our).

By booking an appointment with The Healthy Eating Clinic you agree to be personally bound by these terms and conditions, whether for yourself or on behalf of a minor (as determined by the state in which you reside), if you are booking a consultation on behalf of a minor. By booking an appointment with The Healthy Eating Clinic you represent and warrant that you are at least 18 years old (or the age of majority in your jurisdiction, if it is not 18), and if you are registering on behalf of a minor, that you are their legal guardian.

These terms apply to the use of this website, including the use of the information services provided through this website.

The terms laid out below are to ensure that all clients receive a high quality service and experience. Clients who dispute these terms and conditions will not be able to book future appointments.

When you book an appointment with The Healthy Eating Clinic you agree to the following policies:

Bookings and Payments

To make a booking we require both an email address and a mobile phone number. This is to communicate important information about your appointment and to send automated reminders. We protect you privacy and will only contact you in regards to your appointment and to let you know about any updates to our products and services. You will be denied an appointment if you’re not able to provide these pieces of information.

Payments are required at the time of your appointment by debit or credit card either through our eftpos terminal or over the phone. We do not take cash. Private health insurance is available for on the spot claiming in house or manual claiming for a Telehealth consultation.

Cancellation Policy for Pay-As-You-Go Consultations and Body scans

This policy is strictly enforced and covers all pay-as-you-go services (Private, Medicare and DVA). This policy does NOT cover NDIS consultations (self and plan managed). Please see below for the NDIS policy.

1.1. You may cancel or reschedule your appointment without charge at anytime 24 hours before your appointment.

1.2. Cancellations or reschedules within 24 hours* of your appointment will be charged 50% of the scheduled service fee.

1.3. If you do not call to cancel your appointment or do not show up for your scheduled appointment, you will be charged the full fee for the scheduled service.

1.4. Cancellation fees are due within 14 days. Payments made after the due date will incur a $40 administration fee and are automatically sent for debt collection.

1.5. Cancellations fees may be waived for medical emergencies with presentation of a doctors’ certificate.

1.6. Neither the practitioners nor the customer service staff are authorised to waive cancellation fees.

1.7. Cut off times for arriving for your appointment are 20 minutes for a 60 minute consultation and 10 minutes for a 30 minute consultation. If you arrive prior to these cut off times your consultation may go ahead for the full fee, but your consultation time will be reduced. If you arrive after these cut off times, your consultation will NOT proceed and you must pay for the consultation in full as per the policy above.

*For appointments on a Monday (or Tuesday after a public holiday), notice must be given by COB the Friday prior as the office is not manned over the weekend.

Cancellation Policy for Pre-Paid Consultations and Body Scans (including packages)

This policy is strictly enforced and covers all pre-paid services (Online booking and Packages). This policy does NOT cover NDIS consultations (self and plan managed). Please see below for the NDIS policy.

1.7. You may cancel or reschedule your appointment at anytime 24 hours before your appointment.

1.8. Cancellations or reschedules within 24 hours* of your pre-paid appointment will mean that you forfeit that consultation.

1.9. If you do not call to cancel your appointment or do not show up for your scheduled appointment, you forfeit the consultation.

1.10. This condition may be waived for medical emergencies with presentation of a doctors’ certificate.

1.11. Neither the Practitioners nor the Customer Service staff are authorised to waive cancellation fees.

*For appointments on a Monday (or Tuesday after a public holiday), notice must be given by COB the Friday prior as the office is not manned over the weekend.

Cancellation Policy for NDIS

This policy is strictly enforced for plan and self managed NDIS participants. When you book an NDIS funded consultation (standard, telehealth or kitchen) with The Healthy Eating Clinic you agree to the following cancellation policy:

1.12. Participants and/or their Support Coordinator will provide a minimum of one (1) business days’ notice to reschedule or cancel a scheduled support.

1.13. The Healthy Eating Clinic will recover the full fee associated with the scheduled support if a Participant and/or their Support Coordinator provides a short notice cancellation.

1.14. A cancellation is deemed a short notice cancellation when:

  • The Participant and/or their Support Coordinator has given less than one (1) business days’ notice for a cancellation.

E.g.: A participant contacts the Clinic on 3pm Friday afternoon to cancel an appointment that has been scheduled for 8am next Tuesday following a Monday Public Holiday.

  • The Participant does not show up for a scheduled support within a reasonable time, or is not present at the agreed place and within a reasonable time when the Practitioner is travelling to deliver the scheduled support.

1.15. Fees are due within 14 days. Payments made after the due date will incur a $40 administration fee.

1.16. The Healthy Eating Clinic recognises that there may be circumstances where a Participant is not able to provide sufficient notice to cancel or reschedule a support appointment. Cancellations fees can be waived for medical emergencies upon presentation of a doctors’ certificate.

1.17. Neither the Practitioners nor the Customer Service staff are authorised to waive cancellation fees. Participants are welcome to share any exceptional or unforeseen circumstances that apply with the Clinic’s Managing Director, who will decide if the fee can be waived on a case-by-case basis.

Medicare Policy

2.1. Medicare rebates are available for individual consultations with a dietitian. Medicare rebates are available for patients with chronic conditions and complex care needs or individuals with eating disorders with a Medicare referral from their GP. To be eligible for a rebate, clients must book in with a dietitian and have the documents provided by their GP:

  • Referral Form for Individual Allied Health Services under Medicare for patients with a chronic medical condition and complex care needs.
  • A GP Management Plan (GPMP) – item 721
  • Team Care Arrangement (TCA) – item 723
  • Eating disorder treatment and management plan

2.2. The Medicare rebate for dietetic services is $54.60 and is available for a maximum of five services (chronic disease service) or twenty services (eating disorders) per patient each calendar year. Additional services are not possible in any circumstances. For clients who meet the above criteria, The Healthy Eating Clinic policy for Medicare rebates is as follows:

2.3. First, Second and Support Consultations – Clients will be asked to pay the full cost of the consultation and a Medicare rebate will be processed and deposited into their bank account either through our HICAPS machine or HPOS web claiming.

2.4. To receive the rebate you must have provided The Healthy Eating Clinic with the appropriate referral and paperwork listed above. We are unable to process rebates without this paperwork.

2.4. Bulk billing ceased at The Healthy Eating Clinic on 30th September 2020.

2.5. The standard cancellation policy applies for all Medicare consultations whether fully paid or bulk billed. Cancellation and non-attendance fees must be paid for in full by the client. Medicare rebates or bulk billing can NOT be used to cover the cost of cancellation or non-attendance fees.

DVA Policy

3.1. We welcome DVA clients. DVA Health Cards (Gold and White) are accepted as payment upon a GP referral.

3.2. DVA clients can be referred to a dietitian under a “treatment cycle” consisting of up to 12 sessions

    • Each referral is valid for a year or 12 sessions, whichever ends first
    • They can have as many cycles as clinically indicated in the year
    • They can have concurrent cycles running at the same time e.g. 1 cycle for phsyio, 1 cycle for dietitian

3.3. The standard cancellation policy applies for all DVA consultations. Cancellation and non-attendance fees must be paid for in full by the client. DVA can NOT be used to cover the cost of cancellation or non-attendance fees.

NDIS Policy

4.1. We are able to provide services to plan and self managed NDIS participants.

4.2. We require the details specified in our NDIS referral form before booking a consultation.

4.3. The client is responsible for covering the cost of the consultations should we not receive payment from your plan manager or you’ve run out of funds.

4.2. For plan managed clients we need to be notified if your plan manager changes, prior to booking a consultation.

Private Health Insurance Policy

4.1. If you have private health insurance, any appointment made with one of our dietitians is eligible to receive a rebate from your insurer. HICAPS facilities are available at both practice locations which allows us to offer a rebate at the point of sale. All you have to do is pay the gap.

4.2. The amount you are able to claim with your private health insurer will depend on your level of cover. You can enquire with your private health insurer prior to your consultation if you wish. Simply provide your insurer with the cost of the consultation and the HICAPS item number below to find out how much you will be required to pay. HICAPS item number:

  • First Consultation: 500
  • Second and Support consultations: 600

4.3. Private health insurance does not cover body composition scans.

4.4. You are no able to claim both private health insurance and Medicare for the same appointment.

Refund Policy

5.1. If for any reason you are not completely satisfied with your consultation we may be able to offer you a refund. Please email us at admin@healthyeatinghub.com.au within 7 days if you are not satisfied with your consultation, including the reasons why, so that we can resolve any problems and discuss the next steps.

5.2. Refunds are processed at the discretion of the Managing Director.

5.3. If for any reason you cannot attend a nutrition workshop run by The Healthy Eating Clinic, refunds are NOT available. You may at any time transfer the ticket to another person. If you cannot attend the group session due to unforeseen circumstances we are happy to offer a credit note for future group sessions.

Weight Loss Program

Acceptance

This is a legally binding agreement between You and The Healthy Eating Hub Pty Ltd (The Healthy Eating Clinic). You accept these terms by making payment in full or part towards your 12-week program.

Our Services

We agree to provide all services to you during your 12-week program with care and skill. It is up to the client to implement these lifestyles changes in order to get results. As registered health professionals our dietitians have an ethical responsibility to look after the health and wellbeing of their clients. Your success on this program is our highest priority, however, it is highly dependent on your ability to put what you learn into practice. We cannot guarantee that your will lose a specific amount of weight.

Time bound, 12 Week Consultation Schedule

This is a time bound program. The consultations are only valid within 12 weeks from the date of the first consultation. At the end of the 12 weeks, your consultations expire. Any unattended consultations will not be valid after 12 weeks from the date of the first consultation.

Weeks:     1.  First 1-hour consult + body scan

  1. Second 1-hour consult
  2. First 30min consult
  3. Second 30min consult
  4. No consult
  5. Third 30min consult + body scan
  6. No consult
  7. Fourth 30min consult
  8. No consult
  9. Fifth 30min consult
  10. No consult
    12. Sixth and final 30min consult + body scan

Consultations

Consultations can be delivered in person at either of our Canberra clinics or online via Telehealth. There are 8 consultations and 3 body composition scans included in the cost of the program. First and second consultations are 1 hour long, and the remaining 6 consultations are 30 minutes. All 8 consultations are booked in advance as per the 12-week schedule above at the time of or after payment.

Consultations cannot be booked or moved to different weeks to that set out in the schedule above. The Healthy Eating Clinic cannot guarantee there will be time available to reschedule if you are unable to attend a pre booked consultation.

If you are doing the program completely online and cannot come to our Canberra clinics for your 3 body composition scans, you will be credited one additional 30-minute consultation that you can use after completion of the program. This additional consultation does not expire.

Consultations Cancellations and Reschedules

Reschedules and cancellations within 24 hours of your appointment are strictly forfeited from the program. We welcome reschedules with more than 24 hours’ notice prior to your appointment and we’ll do our best to reschedule you within the week that your consultation was booked. However, due to the limited availability of bookings and the time constraints of the program, if you cannot make the available time slots in the week that your consultation has been booked, as per the schedule, you’ll have to forfeit the consultation from the program.

Payment

Payment for the 12-week program must be made in full prior to commencing the program and before we can book your consultations. Full payment can be made in person via EFTPOS or debit card at one of our clinics, online at the time of booking your First Consultation or securely over the phone with our customer service team.

7 day Cooling Off Period

If you have not had your first consultation, you are entitled to a full refund of the program within 7 days of the purchase date. This is to allow you time if you change your mind about committing to the program. After this cooling off period, refunds are not offered under any circumstances, even if you did not complete the program.

Putting Your Program on Hold

This is a time bound program. There is no option to put the program on hold. The Healthy Eating Clinic does not offer refunds for the weight loss program, if you are away and cannot complete it. Please carefully consider your schedule and availability before purchasing the program. Do not book if you know you will be away for a time and unable to do online consultations. Please also consider your ability to commit to a time bound program as we do not offer refunds if you are unable to put the program information into practice.

Termination/transfers

Any requests to terminate your program must be sent in writing to admin@healthyeatingclinic.com.au. Please note that refunds are NOT available for programs terminated early. The program cannot be transferred from one participant to another.

We strongly encourage you read all the information on our site and in these terms and conditions and consider if this program is for you. We do not offer refunds if you feel dissatisfied with the service or results.

Couples and families

Couples and families are welcome to join under one 12-week program and complete the program together, provided that they attend the consultations together. If they plan to attend separate sessions based on different schedules, than each member of the family wishing to attend separate sessions will need to purchase another 12-week program specifically for them.

Feedback

Your feedback is important to us. We seek to resolve your concerns quickly and effectively. You agree to raise any concerns, problems or issues you may have concerning the 12-week program to us directly in person or via phone or email. We agree to resolve these quickly and in the most appropriate manner.

Medicare and DVA

A Medicare or DVA referral cannot be used to claim rebates against the weight loss program. We do accept Medicare and DVA referrals through our normal consultation stream, so please let our team know if you do have a referral and would like to book in.

Private Health Insurance

Some private health insurers may cover part of the cost of the weight loss program. This is dependent on your policy and is at the discretion of the insurer. Please contact your insurer directly for details of your cover. Once all your pre-paid consultations have been attended, we can provide a receipt of payment outlining the date of each consultation which you are welcome to submit to your insurer.

Privacy

The Healthy Eating Clinic respects your right to privacy. Personal information is information we hold which is identifiable as being you.  The Healthy Eating Clinic complies with privacy requirements as sent out in the Health Records (Privacy and Access) Act 1997 Schedule 1 and shall ensure all practitioners who are part of the team at The Healthy Eating Clinic are aware of those requirements and will do the same. Health and Safety

It is important before beginning any nutrition program, you are healthy enough to do so.  No information contained in this program is intended to be used as medical advice and the program is not intended to be used to diagnose, treat, cure or prevent any medical condition for any therapeutic purpose.

It is at the discretion of the dietitian to assess your eligibility/suitability of the program. If, in the first consultation, your dietitian assesses you to be unsuitable for the program due to health and/or safety reasons, you can continue the consultation with content that is adjusted to better meet your individual care. In this instance only, you may be refunded the difference in cost between a first consultation and the weight loss program.

  • Alpha Fresh – provide free fruit, vegetables, meat and seafood for recipe and content development.

We do not accept responsibility for any loss or damage, however caused (including through negligence), which you may directly or indirectly suffer in connection with or arising from the products or services including acts, omissions and conduct of any third-party users of the Website, other members, other contributors to the Website, and partners. We are not responsible for the products, services, advice, information, actions or failure to act of any partners. Where the information made available over the Website contains opinions or judgements of third parties (including advertisers), we do not purport to endorse the contents of that opinion or advice, nor do we guarantee the accuracy or completeness of that content, and we will not accept liability for loss or damage arising from your reliance upon any information obtained through this service. Nutritional Information

4.1. Nutritional information provided on the Website is taken from sources provided by third parties, including the Food Standards Australia New Zealand (FSANZ) NUTTAB 2010 guide to nutrient content. Before relying on any nutritional information on the Website, you should carefully evaluate the accuracy, completeness and relevance of this information for your purposes, and consider the need to obtain appropriate expert advice relevant to your circumstances. FSANZ has made considerable effort to ensure the quality of information in NUTTAB 2010, however, none of FSANZ, THEH or any other provider of nutritional information on the Website gives any warranty that the information is free from error or suitable for your purposes.

4.2. There are limitations associated with food composition databases. Nutrient data published in a database such as NUTTAB 2010 may represent an average of the nutrient content of a particular sample of foods and ingredients, determined at a particular time. The nutrient composition of foods and ingredients can vary substantially between batches and brands because of a number of factors, including changes in season, changes in formulation, processing practices and ingredient source. While most of the data contained in NUTTAB 2010 are generated from analysed values, some of the data are borrowed from overseas food composition tables; supplied by the food industry; taken from food labels; imputed from similar foods; or calculated using a recipe approach.

Quality of Service

5.1. We do not promise that the Website will be error-free or uninterrupted. The Website and its content are delivered on an “as-is” and “as-available” basis. Receipt of emails, or other Internet based communications such as via Face book or Twitter from us cannot be guaranteed.

Limitation of Liability

Indemnity

You agree to indemnify us and our employees, agents and subcontractors, from and against any third party claims, and must pay on demand all losses, expenses, damages and costs (including reasonable legal fees incurred on a solicitor/client basis) suffered or incurred by us, which arises out of your use of the Website, including your use of the Website to provide a link to another site or to upload content or other information to the Website.
